Bill 122

Bill 122 in Quebec requires Owners to have their building facades and multi-level parking garages inspected regularly by a licensed member of the Ordre des Ingénieurs du Québec (OIQ). The aim of the law is to ensure that facades and parking garages are free from any defect which could jeopardize safety to create dangerous conditions.

Bill 122 Facade

Owners of Residential or Commercial buildings with five or more storeys are required to have a verification report certifying that the facades of the building do not show signs of dangerous conditions. The inspection must be carried out within 6 months before the date of the verification report, and performed every five years.

Frequency of the verification reports

The owner of a building must obtain a verification report at the latest on the day of the 10th anniversary of its construction.

If on March 18, 2013 the building is:

  • more than 45 years of age, a report must be produced before March 18, 2015;
  • more than 25 but less than 45 years of age, a report must be produced before March 18, 2016;
  • more than 15 but less than 25 years of age, a report must be produced before March 18, 2017;
  • more than 10 but less than 15 years of age, a report must be produced before March 18, 2018.

Thereafter, the owner shall obtain a verification report of facades every 5 years.

Bill 122 Parking Garage

Owners of buildings with multi-level parking garages must obtain an in-depth verification report from an engineer that established that the parking garage does not show signs of any dangerous conditions. The inspection must be carried out within 6 months before the date of the verification report, and needs to be performed every five years.

Frequency of the verification reports

The owner of a new garage must obtain an in-depth verification report between 12 and 18 months after the construction work is completed.

If the garage was built over five years ago as at March 18, 2013, the owner must obtain a verification report before March 18, 2016.

Subsequently, the owner must obtain an in-depth verification report every five years.

An in-depth verification must also be carried out following any event that could affect the structural behaviour of the garage.
